What is Texas Forfeiture Law?

Back to Houston Criminal Law Video Frequently Asked Questions

Houston Criminal Law Video Transcription

Texas forfeiture law basically states, in general, that if you use some type of property in the commission of a crime, or to assist you in a crime, that property can be forfeited to the state. Ownership can be taken away from you and given to the state, such as a vehicle. If you’re transporting contraband in a vehicle, that vehicle can be seized and can be forfeited after a legal process. You will have the opportunity to defend yourself and your property in legal proceedings, but you will need to retain an attorney and assert your rights in that proceeding.

Also, they can forfeit money, any type of a money proceeds. Sometimes they can forfeit homes, if they say and can prove that you’re utilizing home to commit crimes. So it’s pretty much any type of property that is the proceeds of crime or used to further crime.
